GENERAL TERMS AND CONDITIONS FOR RECREATION

Based on the RECRON General Terms and Conditions for Holiday Accommodations

At Goudpoel, you're welcome to truly relax — in and around the water, amidst nature. To make this experience as pleasant as possible for everyone, we have clear agreements. You'll find them below. We've written them as clearly and straightforwardly as possible, so you know what to expect and we know what you expect from us.

ARTICLE 1 — WHO WE MEAN — DEFINITIONS

To avoid misunderstandings, we define a few terms:

1. Stay: any form of recreational use of the Goudpoel location, including the waterside lodges, swimming water, and all associated facilities.
2. Goudpoel: the operator providing the accommodation.
3. Guest: the person entering into the agreement with Goudpoel.
4. Co-visitor: anyone who uses the location together with the guest and is listed in the agreement.
5. Third party: someone visiting the guest but not part of the agreement.
6. Price: the amount agreed upon for the use, based on Goudpoel's current price list.
7. Information: the written or digital instructions regarding the use of the location, facilities, and rules — including Goudpoel's house rules.
8. Disputes Committee: the Recreation and Water Sports Disputes Committee in The Hague, composed by ANWB and HISWA-RECRON.
9. Cancellation: written termination of the agreement by the guest before the start date.
10. Dispute: a complaint that has not been resolved to the satisfaction of both parties.

ARTICLE 2 — WHAT YOU CAN EXPECT FROM US

1. Goudpoel provides the agreed-upon spot or facility for recreational use — not for permanent residency.
2. Before entering into the agreement, you will receive all relevant information about your stay, either in writing or digitally. If anything significant changes after the agreement is made, we will inform you promptly.
3. If the information significantly deviates from what was previously agreed upon after the agreement has been made, you have the right to cancel the agreement free of charge.
4. As a guest, you are responsible for adhering to the agreement and the associated information — this also applies to your co-visitors and guests visiting you.
5. Where our house rules or additional agreements conflict with these terms and conditions, these terms and conditions shall prevail. Additional agreements beneficial to the guest are always possible.

ARTICLE 3 — DURATION OF THE AGREEMENT

Your agreement automatically ends after the agreed-upon period. No separate termination is required.

ARTICLE 4 — PRICE AND POTENTIAL PRICE CHANGES

1. The price is determined based on Goudpoel's rates applicable at the time of booking.
2. If, after the agreement has been made, government levies or charges change that directly affect your stay, these costs may be passed on — even if the agreement has already been concluded.

ARTICLE 5 — PAYMENT

1. Payments are made in euros, within the agreed-upon deadlines.
2. If you fail to pay on time and do not do so within two weeks of a written reminder, Goudpoel has the right to immediately terminate the agreement — without releasing you from payment of the full agreed-upon price.
3. If Goudpoel has not received the total outstanding amount by the day of arrival, access may be denied. The right to full payment remains.
4. Extrajudicial costs that Goudpoel reasonably incurs after a notice of default shall be borne by the guest. Statutory interest may be charged on outstanding amounts.

ARTICLE 6 — CANCELLATION — WHAT IF YOU CAN'T MAKE IT?

We understand that plans sometimes change. If you need to cancel, the following fees apply:

1. More than 3 months before arrival: 15% of the agreed-upon price.
2. Between 3 and 2 months before arrival: 50% of the agreed-upon price.
3. Between 2 months and 1 month before arrival: 75% of the agreed-upon price.
4. Within 1 month before arrival: 90% of the agreed-upon price.
5. On the day of arrival itself: 100% of the agreed-upon price.

If the spot is resold to a third party for the same period, or part thereof, with our written consent, we will refund the fee proportionally, after deducting administrative costs.

ARTICLE 7 — USE BY OTHERS

1. Do you want to let someone else use your spot? This is only possible with our prior written consent.
2. Conditions may be attached to this consent, which will also be laid down in writing.

ARTICLE 8 — EARLY DEPARTURE

If you depart earlier than planned, you will owe the full price for the agreed-upon period.

ARTICLE 9 — IF WE HAVE TO TERMINATE THE AGREEMENT

Goudpoel wants everyone to feel welcome and safe. In extreme cases, we may terminate the agreement immediately:

1. If you, your fellow visitors, or guests seriously violate the agreements or the law — despite a written warning.
2. If there is a nuisance to other guests or the surroundings, despite a prior warning.
3. If the accommodation is used contrary to the intended purpose of the location, despite a prior warning.

A termination will always be communicated in writing, including the possibility to submit a dispute to the Disputes Committee. In urgent cases, the warning may be omitted.

After termination, you must vacate the premises as soon as possible, within 4 hours at the latest. The agreed-upon fee generally remains due.

ARTICLE 10 — SAFETY AND LAWS & REGULATIONS

1. Goudpoel ensures at all times that the location complies with all environmental and safety requirements set by the government.
2. As a guest, you are obliged to strictly adhere to the safety regulations on the premises — and to ensure that your fellow visitors and guests do so as well.

At Goudpoel, you are located on open waterways. We ask you to be extra aware of the specific safety rules concerning the water, as described in Goudpoel's house rules.

ARTICLE 11 — MAINTENANCE AND LEAVING TIDY

1. Goudpoel maintains the premises and all common facilities in good condition.
2. You ensure that your spot and the immediate surroundings are left in the same condition as you found them.
3. It is not permitted to dig, cut down trees, prune bushes, or perform other significant alterations to nature or the premises without permission.

ARTICLE 12 — LIABILITY

1. Goudpoel's legal liability for damages other than injury or death is limited to a maximum of € 455,000 per event. Goudpoel is insured for this.
2. Goudpoel is not liable for accidents, theft, or damage on the premises, unless it is demonstrably the result of a shortcoming on our part.
3. Goudpoel is not liable for damages resulting from extreme weather conditions or other forms of force majeure.
4. In the event of utility failures, Goudpoel is liable, unless it is due to force majeure.
5. The guest is liable for damages caused by themselves, their fellow visitors, or guests on the premises, insofar as this can be attributed to them.
6. If you report nuisance from other guests, we will take appropriate measures.

ARTICLE 13 — DISPUTES — IF WE CAN'T RESOLVE IT TOGETHER

We hope it never comes to this, but should there be a complaint that we cannot resolve together:

1. Dutch law applies to all disputes.
2. Both the guest and Goudpoel are bound by the rulings of the Recreation and Water Sports Disputes Committee.
3. A dispute must be submitted to the Disputes Committee no later than 12 months after filing the complaint.
4. If Goudpoel wishes to initiate a dispute, we will first ask the guest in writing if they wish to go to the Disputes Committee. If this is not confirmed within five weeks, we are free to submit it to the court.
5. The Disputes Committee does not handle disputes concerning illness, injury, death, or unpaid invoices without a material complaint.
6. A fee is due for the handling of a dispute.

ARTICLE 14 — HISWA-RECRON COMPLIANCE GUARANTEE

1. If Goudpoel is a member of HISWA-RECRON, HISWA-RECRON guarantees compliance with a binding advice from the Disputes Committee, provided Goudpoel does not comply in a timely manner — under the applicable conditions.
2. If Goudpoel has submitted the binding advice to the court for review within two months, compliance will be suspended until the court has rendered its decision.
3. To invoke the compliance guarantee, the guest must report this in writing to HISWA-RECRON.

ARTICLE 15 — AMENDMENTS TO THESE TERMS AND CONDITIONS

Changes to these terms can only be made in consultation with consumer organizations, in this case represented by the ANWB.
